Asynchronous Telemedicine Informed Consent

Before you receive care, you will be asked to confirm that you have read and understood this consent. BY AGREEING, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE TERMS BELOW AND THE RISKS AND BENEFITS OF ASYNCHRONOUS TELEMEDICINE, AND YOU GIVE YOUR INFORMED CONSENT TO PARTICIPATE IN ASYNCHRONOUS TELEMEDICINE UNDER THESE TERMS.

Who provides your care

Medical care available through Zoya is provided by independent, licensed health care practitioners through Arora Health & Aesthetics, LLC and similar affiliated professional entities (the “Medical Group”). Your practitioner is licensed in your state. Zoya Health LLC provides the technology platform and administrative support and does not practice medicine.

What is telemedicine?

Telemedicine is the delivery of health care services — including examination, consultation, diagnosis, and treatment — through electronic communication technologies, when you and your health care practitioner are not in the same physical location. Telemedicine allows you to receive care without traveling to an office or scheduling a separate in-person appointment, and helps you avoid the wait times of an in-person visit.

What is asynchronous telemedicine?

Asynchronous telemedicine — often called “store-and-forward” communication — is telemedicine in which participants submit and review information at different times, rather than in a live interaction. Examples include completing a health questionnaire that a practitioner reviews later, and exchanging messages, photos, or other information with your practitioner through the patient portal or by text message. “Asynchronous” means “not occurring at the same time,” in contrast to “synchronous” telemedicine, which takes place in real time by phone or video.

The platform used for your care supports: (1) secure, structured collection of your health information through store-and-forward questionnaires; and (2) practitioner-patient communication through the patient portal and, where offered and consented to, text (SMS/MMS) messaging. Practitioners may use asynchronous telemedicine to aid diagnosis and treatment when live communication or face-to-face contact is not necessary. Where state law requires a synchronous (live) visit, one will be arranged before treatment.

Possible risks of asynchronous telemedicine

As with any form of medical care, asynchronous telemedicine carries potential risks. The likelihood of these risks materializing is believed to be low, but they include, without limitation:

Delays in evaluation, consultation, or treatment caused by equipment or internet deficiencies or failures, including poor data quality, outages, or other service interruptions. If an interruption occurs, your encounter can be resumed or rescheduled.

Failure of security protocols, resulting in a breach of privacy of personal medical information.

Incomplete information risks: your practitioner does not have access to your complete medical records. If you do not disclose your full medical history — including diagnoses, treatments, medications and supplements, and allergies — adverse treatment outcomes, drug interactions, or allergic reactions may occur.

Asynchronous telemedicine services are NOT emergency services, and your communications WILL NOT be monitored 24/7. IF YOU THINK YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY.

THE CARE YOU RECEIVE IS AT THE SOLE DISCRETION OF THE HEALTH CARE PRACTITIONER TREATING YOU, WITH NO GUARANTEE OF DIAGNOSIS, TREATMENT, OR PRESCRIPTION. YOUR PRACTITIONER WILL DETERMINE WHETHER THE CONDITION BEING EVALUATED IS APPROPRIATE FOR CARE THROUGH AN ASYNCHRONOUS TELEMEDICINE ENCOUNTER.

Your rights and acknowledgements

You have the same privacy rights in asynchronous telemedicine that you would have during an in-person visit. Identifiable images or information from your telemedicine visit will not be shared with researchers or other outside entities without your written consent. How your information is protected is described in our Privacy Policy and the HIPAA Notice of Privacy Practices, both available on this website.

Asynchronous telemedicine may involve electronic transmission of your personal medical information to health care practitioners located in other areas, including out of state.

You may expect the anticipated benefits of asynchronous telemedicine, but no results can be guaranteed or assured.

All information you submit in connection with your care, and the information your practitioner enters into the platform, becomes part of your medical record. You may request access to your medical record at any time by emailing Hello@JoinZoya.com; we will coordinate with the Medical Group to provide it. Your record is subject to the same restrictions on disclosure without your consent as any medical record.

Your practitioner's first message to you will include their name and credentials, and this is recorded in your medical record.

You may withdraw this consent and discontinue telemedicine care at any time by emailing Hello@JoinZoya.com. Withdrawing consent does not affect care already provided, and your practitioner may recommend in-person care where appropriate.

Your health care information may be shared in accordance with our Privacy Policy, the HIPAA Notice of Privacy Practices, and the laws of the state or territory where you are located — including: when a valid court order is issued for medical records; when reporting suspected abuse, neglect, or domestic violence; and when necessary to prevent or reduce a serious threat to anyone's health or safety.

Call, email, and text messaging consent

You expressly consent to Zoya Health, the Medical Group, and their health care practitioners calling, emailing, or texting you (via SMS and/or MMS) regarding your care, appointments, orders, and similar matters related to your telemedicine encounters, using the contact information you have provided. Calls or texts may be placed using an auto-dialer or a pre-recorded or artificial voice, even if your number is on a do-not-call list. Your carrier's normal message and data rates may apply. This consent is not a condition of purchase, and you may revoke it at any time by emailing Hello@JoinZoya.com or by replying STOP to any text message.

Standard text messages and email are not encrypted. If you choose to communicate about your health by text or email, you accept the risk that those communications may be intercepted by third parties. For secure communication with your care team, use the patient portal.

Duration of this consent

This Asynchronous Telemedicine Informed Consent is valid for the entire duration of your treatment through the platform, unless and until you withdraw it as described above.

Zoya Health LLC is not a pharmacy or a medical provider. Medical services are provided by independent, licensed healthcare providers through Arora Health & Aesthetics, LLC. Prescription medications are available only if a licensed provider determines a prescription is appropriate after a medical evaluation, and are dispensed by state-licensed pharmacy partners. Compounded medications are prepared by state-licensed compounding pharmacies operating under Section 503A of the federal Food, Drug & Cosmetic Act and are not FDA-approved as finished drug products.
